TikTok is a powerful platform for individuals, brands, and businesses to reach massive audiences and generate sales. With TikTok Shop users can buy directly, sell physical products to customers, host live selling events, list items in videos via product links. Products that do well on TikTok tend to be Visually appealing (skincare), trendy or viral (capitalizing on current challenges or memes), affordable (typically under $50), useful or solve a problem (beauty hacks).

But, if you’re selling FDA-regulated products, you must ensure you’re playing by the rules.

THE RISE OF TIKTOK E-COMMERCE

TikTok has rapidly evolved from a social media app for short-form videos into a major e-commerce platform. Sellers now use TikTok to showcase, market, and sell a wide variety of products, from beauty items to supplements and even medical devices. With the “TikTok Shop” feature, the platform is making it easier than ever for influencers and brands to monetize their presence.

But with this opportunity comes responsibility, especially if you’re selling products regulated by the U.S. Food and Drug Administration (FDA). Many TikTok sellers don’t realize that certain products they offer may require FDA registration and compliance to avoid serious legal and financial consequences.

WHAT IS FDA REGISTRATION & COMPLIANCE?

FDA registration is the process through which manufacturers, repackagers, or sellers of regulated products notify the FDA about their operations. This registration helps the FDA monitor the safety and efficacy of products that reach U.S. consumers.

FDA registration typically applies to businesses involved in products such as:

▪ Food and beverages

▪ Dietary supplements

▪ Cosmetics

▪ Medical devices

▪ Over-the-counter (OTC) drugs

▪ Infant formula and other specialized foods

Importantly, FDA registration does not mean FDA approval. For example, cosmetics and dietary supplements do not require FDA approval before being sold, but their manufacturers must still follow FDA regulations, including accurate labeling and not making false claims.

WHO NEEDS FDA REGISTRATION ON TIKTOK?

If you’re a TikTok seller offering products in any of the FDA-regulated categories above, you may need to register with the FDA or ensure your supplier is registered. Common TikTok-sold products that often require FDA oversight include:

▪ Weight loss teas or gummies (Dietary supplements)

▪ Skincare products claiming to treat acne or wrinkles (Drugs or cosmetics)

▪ Teeth-whitening kits (Could be classified as medical devices)

▪ Imported snacks and beverages (Food facility registration)

▪ Contact lenses or eye drops (Medical devices or OTC drugs)

If you’re selling these kinds of products, either directly from your own inventory or through dropshipping, you may be considered a “responsible party” and thus fall under FDA oversight.

FDA REGISTRATION VS FDA APPROVAL

A common mistake among new TikTok sellers is thinking that FDA registration equals FDA approval. Here’s the difference:

FDA Registration means your facility is known to the FDA and is complying with basic regulatory requirements.

FDA Approval involves a lengthy review process for safety and effectiveness, required mostly for prescription drugs and certain medical devices.

For example, if you sell a vitamin C supplement, you don’t need FDA approval, but your facility must be registered, and your labeling must not make unauthorized health claims.

THE RISKS OF NON-COMPLIANCE

Selling FDA-regulated products without proper registration or compliance can result in serious consequences:

▪ Product seizures or recalls

▪ Bans from TikTok Shop

▪ Warning letters from the FDA

▪ Fines or legal action

▪ Import holds by U.S. Customs

Additionally, if you’re sourcing from international suppliers, your products could be stopped at the border if the facility isn’t FDA-registered or if labeling doesn’t meet U.S. standards.

TikTok itself has been increasingly proactive in removing non-compliant sellers and products, especially as regulators scrutinize social media commerce more closely.

U.S. AGENT REQUIREMENT

Foreign establishments or facilities exporting to the United States must identify an FDA U.S. Agent during the registration process.

Therefore, most foreign establishments or facilities expect their U.S. Agent to be at least bilingual.

Also, time zones not just in the United States, but around the world are usually challenging. U.S. Agents working hours can make a difference.

After a foreign facility submits a registration, FDA will verify that the person or entity identified as the U.S. Agent, such as ITB HOLDINGS LLC, has agreed to serve.

The FDA sends a confirmation notification of a foreign facility registration to the U.S. Agent, to ensure that the U.S. Agent is aware of the connection.

The agency will not confirm any registration or provide the foreign facility with a registration number until the U.S. Agent’s confirmation within 30 days.

If the U.S. Agent wishes to no longer serve the already registered foreign facility, the foreign facility will have 60 calendar days to update the facility’s registration with a new U.S. Agent.

In most cases, the registration of the foreign company is simply processed by the U.S. Agent, upon request and payment of a service fee.
